Terms of service

1. Definitions & Scope of Services

"Company," "we," "us," or "our" refers to Diamond Phoenix Creations. "Customer," "you," or "your" refers to any individual or business placing an order. "Services" includes commercial/offset printing, digital printing, large-format/signage printing, and apparel/merchandise production.

These Terms apply to all orders placed in person, by phone, by email, or through our website or any other channel.


2. Orders & File Submission

All orders are subject to acceptance by Diamond Phoenix Creations. We reserve the right to refuse any order at our discretion.

  • Orders are confirmed only upon receipt of a written or electronic order acknowledgement from us.
  • Customers are responsible for submitting print-ready files meeting our current file specifications (available on request or on our website).
  • We accept files in the following formats: PDF (preferred), AI, EPS, PSD, SVG, and TIFF. Files must be submitted at the correct resolution (minimum 300 DPI for print, 150 DPI for large format).
  • We are not responsible for errors resulting from incorrect, low-resolution, or improperly formatted files submitted by the customer.
  • Orders cannot be modified or cancelled once production has begun. Cancellation requests before production may be subject to a fee to cover setup costs.

3. Intellectual Property & Content Policy

By submitting files or artwork, you represent and warrant that:

  • You own or have the legal right to reproduce all content, images, logos, and trademarks included in your files.
  • Your content does not infringe any third-party intellectual property rights.
  • Your content does not violate any applicable law, including laws relating to defamation, obscenity, or hate speech.

We reserve the right to refuse production of any content we deem offensive, unlawful, or in violation of these Terms. The customer agrees to indemnify and hold [Your Company Name] harmless from any claims arising from the content of their print materials.


4. Pricing, Payment & Quotes

  • All prices are quoted in Canadian dollars and are exclusive of applicable taxes (GST/HST/QST) unless stated otherwise.
  • Quotes are valid for 30 days from the date of issue and are subject to change if project specifications change.
  • Payment is due in full prior to production unless a credit account has been established. Net-30 terms may be available for approved business accounts.
  • We accept payment by credit card, e-transfer, cheque, or cash. A processing fee may apply to credit card payments over a certain amount.
  • Overdue invoices are subject to interest at 1.5% per month (18% per annum). We reserve the right to withhold delivery of completed orders until payment is received in full.

5. Production, Turnaround & Shipping

  • Stated turnaround times are estimates and begin once print-ready files and payment have been received and confirmed.
  • We are not liable for delays caused by factors outside our control, including equipment failure, material shortages, shipping carrier delays, or force majeure events.
  • Rush production may be available at an additional charge, subject to capacity.
  • Risk of loss or damage passes to the customer upon delivery to the shipping carrier. We recommend purchasing shipping insurance for high-value orders.
  • Overages or underages of up to 10% of the ordered quantity are considered acceptable for commercial/offset print runs and will be billed or credited accordingly.

6. Proofing & Colour Accuracy

Colour representation on screen and in digital proofs may differ from final printed output due to differences between RGB (screen) and CMYK (print) colour spaces.

  • A digital proof will be provided upon request and must be approved in writing before production begins.
  • Hard-copy press proofs are available for an additional fee.
  • Once a proof is approved by the customer, Diamond Phoenix Creations is not responsible for errors in content, colour, or layout.
  • Exact colour matching is not guaranteed unless a specific Pantone (PMS) colour match is agreed upon in writing and a press proof is approved.

7. Returns, Reprints & Refunds

Due to the custom nature of printed products, all sales are final unless the product is defective or differs materially from the approved proof.

  • Claims for defective or incorrect orders must be submitted in writing within 5 business days of delivery, with photographic evidence.
  • If a claim is accepted, our sole obligation is to reprint the affected items. Refunds are issued at our discretion.
  • We are not responsible for errors in customer-supplied content, including typos, wrong images, or incorrect file specifications, after proof approval.

8. Apparel & Merchandise

  • Garment sizing, colourfastness, and fabric composition are subject to manufacturer specifications and may vary between production runs.
  • An industry-standard variance of ±5% in ink coverage and placement is acceptable for decorated apparel.
  • We are not responsible for garment shrinkage, fading, or damage caused by improper washing or care by the customer after delivery.
  • Minimum order quantities may apply for certain apparel and merchandise items.

9. Large Format & Signage

  • The customer is responsible for confirming that materials selected are appropriate for their intended installation environment (indoor/outdoor, UV exposure, etc.).
  • Installation services, if offered, are quoted separately and are subject to site conditions. We are not liable for damage to surfaces during installation unless caused by our negligence.
  • Outdoor signage longevity is dependent on environmental conditions and is not guaranteed beyond the manufacturer's specifications for the chosen substrate and laminate.

10. Limitation of Liability

To the fullest extent permitted by law, Diamond Phoenix Creations liability for any claim arising from these Terms or any order shall not exceed the amount paid by the customer for the specific order giving rise to the claim.

We are not liable for any indirect, consequential, incidental, or special damages, including lost profits or business interruption, even if advised of the possibility of such damages.


11. Governing Law & Disputes

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Quebec, and both parties consent to the jurisdiction of such courts.

We encourage customers to contact us directly to resolve any disputes before initiating legal proceedings.


12. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on our website and take effect immediately. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
